Terms of Use
These Terms of Use (“Terms”) govern your use of kadi-hub.com and its subpages (the “Site”), operated by KA&DI HUB LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, USA (“KA&DI HUB”, “we”, “us”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. About the Site
The Site presents KA&DI HUB, our services and our work, and hosts individual partnership proposal pages prepared for specific experts and businesses. Content on the Site is for general information. It is not an offer that becomes binding when you read it: any services are provided only under a separate written agreement, proposal or invoice, whose terms prevail over these Terms.
We work through two companies. Clients in the European Economic Area contract with KaDiHub OÜ (Estonia, registry code 17619703, Jõe tn 3-406, 10151 Tallinn). All other clients contract with KA&DI HUB LLC (New Mexico, USA). Each proposal, agreement or invoice names the company you contract with.
2. Acceptable use
You may use the Site for lawful, personal or business information purposes. You agree not to:
- use the Site in a way that breaks any law or the rights of others;
- try to gain unauthorized access to the Site, its servers or related systems, or interfere with their operation;
- scrape, copy or harvest content or data from the Site by automated means beyond what normal search engine indexing requires;
- introduce viruses or other harmful code;
- misrepresent your identity or affiliation with KA&DI HUB.
3. Proposal pages
Some pages contain proposals prepared for a specific person or company. They may include that party’s name, photos or materials, used with their knowledge for the purpose of the proposal. Such pages are not public offers, and figures, forecasts and plans on them are estimates, not promises. Please do not copy or distribute them without our consent.
4. Intellectual property
The Site and its content — texts, design, graphics, logos, the KA&DI HUB name, images and code — are owned by KA&DI HUB LLC, KaDiHub OÜ or our clients, partners and licensors, and are protected by copyright, trademark and other laws. Case studies and client materials remain the property of their respective owners.
You may view and print pages for your own non-commercial use. Any other use — copying, modifying, republishing, selling or creating derivative works — requires our prior written permission.
5. Third-party links and services
The Site links to and uses third-party websites and services (for example case study sites, YouTube, Google). We do not control them and are not responsible for their content, availability or privacy practices. Your use of them is subject to their own terms.
6. No guarantee of results
Results described on the Site, including revenue figures and case studies, reflect specific past projects. They are not typical, and they do not guarantee that you will achieve similar results. Marketing and sales results depend on many factors, including your product, prices, market, audience and effort.
7. Disclaimer of warranties
The Site is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that its content is complete or up to date.
8. Limitation of liability
To the fullest extent permitted by law, KA&DI HUB LLC, KaDiHub OÜ and their members, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to your use of, or inability to use, the Site, even if we were advised of the possibility of such damages.
Our total liability for any claim related to the Site will not exceed one hundred US dollars (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, or the mandatory rights you have as a consumer under the law of your country.
9. Indemnification
You agree to indemnify and hold KA&DI HUB LLC and KaDiHub OÜ harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.
10. Governing law and disputes
These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be resolved exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to their jurisdiction. If you are a consumer living in the EU or UK, you also keep the protection of the mandatory laws of your country and may bring claims in your local courts.
11. Changes to these Terms
We may update these Terms from time to time. The new version takes effect when posted on this page with a new date. If you keep using the Site after that, you accept the updated Terms.
12. Other
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site.
